Welcome to ConneryFilm! We are thrilled to be considered for capturing your extraordinary love story. These Terms and Conditions (the "Agreement") outline the understanding between Connery Davoodian, operating as ConneryFilm ("Photographer/Videographer," "We," "Us," or "Our"), and the client(s) (collectively, "Client," "You," or "Your") for all wedding photography and videography services. By booking our services, you agree to be bound by these terms.
1. Services Provided
1.1. Scope of Work:
ConneryFilm agrees to provide professional photography and/or videography services as detailed in your specific package selection and any agreed-upon add-ons. The specific package, deliverables, coverage hours, and locations will be outlined in a separate, personalized Proposal or Contract provided to You.
1.2. Creative Control:
ConneryFilm retains full creative control over the editing process, including but not limited to, the selection of images/footage, color correction, cropping, retouching, and the overall artistic style. Our work is a reflection of our artistic vision and brand, as showcased on
and our social media. While we welcome your input, final artistic decisions rest with ConneryFilm. Not all raw footage or unedited images will be provided.
1.3. Specific Shots/Requests:
We will make every reasonable effort to capture specific shots or fulfill special requests (e.g., a "shot list") provided by the Client in advance. However, due to the dynamic and unpredictable nature of live events like weddings, no specific shot or pose can be guaranteed. Our priority is to capture the authentic moments and flow of your day.
2. Booking, Payments, and Cancellations
2.1. Booking & Retainer:
A signed Agreement and a non-refundable, non-transferable retainer (deposit) as specified in your Proposal/Contract are required to secure your wedding date. No date is considered reserved until both are received.
2.2. Payment Schedule:
The remaining balance will be due according to the payment schedule outlined in your Proposal/Contract. Typically, the full balance is due [X days, e.g., 30-60 days] prior to the wedding date.
2.3. Late Payments:
Payments not received by the due date may incur a late fee of [e.g., 5%] per month or portion thereof on the outstanding balance. ConneryFilm reserves the right to withhold services, including delivery of final products, until all outstanding balances are paid in full.
2.4. Cancellation by Client:
In the event of Client cancellation, the retainer is non-refundable. If the cancellation occurs within [e.g., 90 days] of the wedding date, the Client may be responsible for a percentage of the remaining balance, as outlined in your Proposal/Contract, to compensate for lost business opportunities. All cancellations must be made in writing.
2.5. Postponement/Rescheduling by Client:
If the Client postpones or reschedules the wedding, ConneryFilm will make every reasonable effort to accommodate the new date, subject to our availability. If we are available, any payments made will be applied to the new date, and a rescheduling fee of [e.g., $500] may apply. If ConneryFilm is unavailable for the new date, the retainer will be forfeited, and any other payments made may be subject to our cancellation policy (Clause 2.4).
2.6. Cancellation by ConneryFilm:
In the unlikely event ConneryFilm must cancel due to unforeseen circumstances beyond our control (e.g., illness, injury, force majeure event), we will make every effort to find a suitable replacement photographer/videographer of comparable skill and style. If a replacement cannot be found, all monies paid by the Client will be fully refunded, and ConneryFilm's liability will be limited to the total amount paid by the Client.
3. Event Details & Logistics
3.1. Schedule Confirmation:
The Client is responsible for providing ConneryFilm with a detailed wedding day schedule at least [e.g., two weeks] prior to the event. Any changes to the schedule or locations must be communicated promptly in writing. ConneryFilm is not responsible for compromised coverage due to delays caused by the Client, bridal party, guests, or other vendors.
3.2. Venue Restrictions:
The Client is responsible for obtaining any necessary permits, permissions, or clearances from the wedding venue(s) regarding photography and videography. ConneryFilm is not responsible for limitations imposed by venue management (e.g., restrictions on flash, movement, or specific shot locations).
3.3. Meals:
For coverage exceeding [e.g., 6 hours], the Client agrees to provide a hot meal for ConneryFilm and any accompanying team members. This ensures our team remains energized and focused on capturing your day without needing to leave the venue.
3.4. Safe Working Environment:
The Client agrees to provide a safe and harassment-free working environment for ConneryFilm and its team members. In the event of unsafe conditions or hostile behavior, ConneryFilm reserves the right to cease services immediately without refund.
3.5. Exclusive Photographer/Videographer:
Unless otherwise agreed upon in writing, ConneryFilm will be the exclusive professional photographer(s) and/or videographer(s) for your wedding. While guests are welcome to take their own photos, we ask that they not obstruct or interfere with our professional duties.
4. Delivery & Usage of Media
4.1. Delivery Timeline:
Final edited digital photos and videos will be delivered within the timeframe specified in your Proposal/Contract (typically [e.g., 8-12 weeks] for photos and [e.g., 12-16 weeks] for videos, following the wedding date). This timeline may be extended during peak seasons or for complex projects, which will be communicated.
4.2. Digital Files & Storage:
We strongly recommend that you download and back up all delivered digital files to multiple locations immediately upon receipt. ConneryFilm is not responsible for the lifespan of any digital media provided or for future changes in technology that may affect your ability to view or access files. We will retain a backup of your final deliverables for a period of [e.g., one year] from the delivery date.
4.3. Copyright & Usage:
ConneryFilm retains the full copyright to all images and video footage created. The Client is granted a non-exclusive, non-transferable, perpetual license to use the final deliverables for personal, non-commercial purposes only (e.g., printing for personal display, sharing with friends and family, posting on personal social media with credit to ConneryFilm).
4.4. Commercial Use & Alteration:
The Client may not sell, reproduce for commercial gain, or materially alter the images or video without prior written consent from ConneryFilm. This includes applying additional filters or heavy editing that changes the artistic integrity of the work.
4.5. Promotional Use:
The Client grants ConneryFilm the irrevocable and unrestricted right to use and publish images and video footage from your wedding for promotional purposes, including but not limited to, our website, social media, marketing materials, portfolios, and industry competitions. This helps us showcase our artistry and attract future clients. If you have specific privacy concerns, please discuss them with us in advance.
4.6. Model Release:
Your booking constitutes a model release, granting ConneryFilm permission to photograph and video you and your guests for the purposes outlined in Clause 4.5.
5. Limitation of Liability
5.1. Force Majeure:
ConneryFilm will not be liable for any failure or delay in performing its obligations under this Agreement due to causes beyond its reasonable control, including but not limited to
acts of God, natural disasters, severe weather, strikes, government restrictions, epidemics, pandemics, or unforeseen technical failures (e.g., equipment malfunction, data loss despite reasonable precautions). In such cases, ConneryFilm's liability will be limited to a refund of monies paid, proportional to services not rendered.
5.2. Maximum Liability:
In the event of any claim, ConneryFilm's liability to the Client shall not exceed the total amount paid by the Client for the services rendered under this Agreement. ConneryFilm shall not be liable for any indirect, incidental, special, or consequential damages.
5.3. Cooperation:
ConneryFilm is not responsible for lack of coverage due to Client or guest non-cooperation, tardiness, failure to obtain necessary permissions, or other conditions beyond our reasonable control.
5.4. Insurance:
ConneryFilm maintains professional liability insurance.
6. Miscellaneous6.1. Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any disputes arising under this Agreement shall be
resolved in the courts of Los Angeles County, California.
6.2. Entire Agreement:
This Agreement, along with the Proposal/
Contract, constitutes the entire agreement between the parties and supersedes all prior discussions, negotiations, and agreements, whether oral or written.
6.3. Amendments:
Any changes or amendments to this Agreement must be made in writing and
signed by both parties. 6.4. Severability: If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
6.5. Headings:
The headings in this Agreement are for convenience only and shall not affect its interpretation.
